These terms apply to all vehicle recovery services provided by The Recovery Man. By engaging our services, you agree to these terms and conditions.

💰 PAYMENT TERMS

Payment Due Dates

  • Emergency Callouts: Payment due immediately upon completion of service
  • Standard Recovery: Payment due within 7 days of invoice date
  • Commercial Accounts: Payment due within 30 days (subject to credit approval)

Late Payment Charges

Under the Late Payment of Commercial Debts (Interest) Act 1998, we are legally entitled to charge interest and recovery costs on overdue accounts:

  • Interest Rate: 8% above Bank of England base rate (currently approximately 13.25% per annum)
  • Interest Calculation: Charged daily from the due date until payment is received in full
  • Debt Recovery Costs: £40 (debts under £1,000), £70 (£1,000-£9,999.99), £100 (debts over £10,000)
  • Additional Costs: Reasonable legal and administrative costs may be charged for persistent non-payment

  • Cash (emergency callouts)
  • Bank transfer (preferred for invoiced work)
  • Card payments (where facilities available)
  • Cheques (subject to clearance)

🔧 SERVICE CONDITIONS

Service Scope

  • Emergency recovery services for disabled, broken-down, and non-operational vehicles
  • Accident recovery and vehicle relocation services
  • Services provided within a 62-mile radius of Tyldesley, Greater Manchester
  • We do NOT provide general vehicle transportation or haulage services

Vehicle Requirements

  • Vehicles must be suitable for loading onto our car transporter trailer
  • Maximum vehicle weight and size restrictions apply
  • Additional charges apply for SUVs (+£10) and vans/light commercial vehicles (+£20)
  • We reserve the right to refuse recovery of vehicles deemed unsafe or unsuitable

Customer Responsibilities

  • Provide accurate location and vehicle details when booking
  • Ensure safe access to the vehicle for recovery
  • Remove all personal belongings before recovery (we are not responsible for items left in vehicles)
  • Provide proof of ownership or authority to recover the vehicle

🛡️ LIABILITY & INSURANCE

Our Insurance Coverage

  • Goods in Transit (GIT) Insurance: Full coverage for your vehicle during transportation
  • Public Liability Insurance: Comprehensive coverage for third-party claims
  • Road Risks Insurance: Specialist coverage for recovery operations
  • Professional Indemnity: Coverage for professional services provided

Liability Limitations

  • We are not liable for pre-existing damage to vehicles
  • Personal belongings left in vehicles are not covered
  • Consequential losses (e.g., loss of earnings, missed appointments) are excluded
  • Claims must be reported within 7 days of service completion

📋 CANCELLATION & DISPUTES

Cancellation Policy

  • Cancellations more than 30 minutes before arrival: No charge
  • Cancellations within 30 minutes of arrival: 50% of quoted price
  • Cancellations after arrival on site: Full quoted price applies
  • Wasted journey charges apply if vehicle cannot be recovered due to customer error

Dispute Resolution

  • All disputes should be raised within 7 days of service completion
  • We aim to resolve all complaints within 14 days
  • Unresolved disputes may be referred to alternative dispute resolution
  • These terms are governed by English law and subject to UK jurisdiction

⚖️ LEGAL COMPLIANCE

Recovery Exemptions: The Recovery Man operates under vehicle recovery exemptions as defined by UK transport regulations, providing emergency breakdown and accident recovery services for disabled, broken-down, and non-operational vehicles.

Regulatory Compliance: All recovery operations are conducted in full compliance with UK recovery regulations, DVSA requirements, and health & safety legislation.

Data Protection: We comply with UK GDPR and Data Protection Act 2018. Customer information is processed lawfully and securely for service delivery and legal obligations only.

Consumer Rights: These terms do not affect your statutory rights under the Consumer Rights Act 2015 where applicable.

By engaging The Recovery Man for vehicle recovery services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Business. These terms form part of the contract between you and The Recovery Man.
